ASSEMBLE SKILLS – TERMS AND CONDITIONS

These Terms and Conditions apply to courses, training, assessments, NVQ portfolio assessment services and other services supplied by Assemble Skills Ltd (“Assemble Skills”, “we”, “us” or “our”).
By booking, enrolling, making payment, commencing training, attending an induction or using our services, you (“the Student”, “Learner” or “Customer”) agree to these Terms and Conditions.
Nothing in these Terms affects any statutory rights which cannot lawfully be excluded or restricted.
1. About Assemble Skills
Assemble Skills Ltd provides electrical training, qualifications, assessments and NVQ portfolio assessment services.
Certain qualifications are regulated or awarded by external awarding organisations. Where applicable, learners must comply with both these Terms and the relevant awarding organisation's regulations, assessment requirements and policies.

2. Enrolment and Acceptance
A booking or payment does not automatically guarantee that a learner is eligible for a particular qualification.
Learners are responsible for providing accurate information about their:
-
previous qualifications;
-
industry experience;
-
employment;
-
site access;
-
work experience;
-
identification;
-
certificates; and
-
any other information relevant to qualification entry requirements.
Where a qualification has mandatory entry requirements, Assemble Skills may request evidence before or after enrolment.
If information supplied by a learner is false, misleading, incomplete or materially different from the learner's actual circumstances, we may suspend or cancel the enrolment.
Where possible, we will attempt to offer an appropriate alternative route.
3. Course and Qualification Entry Requirements
It is the learner's responsibility to ensure they meet the stated entry requirements for their chosen qualification.
Assemble Skills will provide reasonable guidance regarding qualification routes, but final eligibility may also be subject to awarding organisation requirements.
Where an awarding organisation refuses registration because a learner does not satisfy its mandatory requirements, Assemble Skills will consider the circumstances and any refund or alternative arrangement in accordance with applicable law and the costs and services already incurred or provided.
PAYMENTS
4. Course Fees
Course and assessment fees are those shown on the Assemble Skills website, quotation, invoice, enrolment agreement or payment plan applicable at the time of booking.
The learner is responsible for paying all agreed fees by the relevant due dates.
Where a payment plan is agreed, the payment plan forms part of the learner's contract with Assemble Skills.
5. NVQ Payment Plans
Where a learner chooses to pay for an NVQ using an agreed monthly payment plan:
-
payments must be made on the agreed due dates;
-
payments are consecutive monthly payments and are not payable on an “as and when” basis;
-
unless a different written payment schedule has expressly been agreed, the NVQ must be paid for in full within three months of commencement;
-
the learner remains responsible for the full amount due under the agreed payment plan, subject to their statutory rights and these Terms; and
-
an interruption in the learner's portfolio activity does not automatically pause the payment schedule.
Awarding Organisation Registration
Where an NVQ learner is paying by instalments, Assemble Skills will normally register the learner with the relevant awarding organisation only once the second agreed payment has been received and cleared.
Access to induction, portfolio guidance or Assemble Skills resources before awarding organisation registration does not mean that awarding organisation registration has taken place.
The learner must keep their payments up to date to prevent delays to registration, assessment or certification.
6. Missed or Late Payments
Where an instalment is overdue, Assemble Skills may suspend access to:
-
assessors;
-
portfolio assessment;
-
portfolio platforms;
-
learning materials;
-
site visits;
-
progress reviews;
-
assessment bookings; and
-
other services
until the account is brought up to date.
We will normally attempt to contact the learner regarding an overdue payment before terminating the service.
Persistent failure to pay, refusal to pay or failure to respond to reasonable requests for payment may result in cancellation of the learner's service.
Where a service is terminated because of non-payment, any refund entitlement will be determined in accordance with applicable consumer law, the services already provided, resources supplied and reasonable losses incurred by Assemble Skills.
Outstanding sums lawfully due remain payable.
NVQ PORTFOLIO ASSESSMENT
7. Nature of the NVQ Service
An NVQ portfolio service is primarily an assessment service rather than a taught classroom course.
The learner is responsible for carrying out genuine work in the workplace and producing sufficient authentic evidence to demonstrate competence against the requirements of the qualification.
Assemble Skills will provide assessment, guidance, feedback and support but cannot complete a learner's portfolio or workplace evidence on their behalf.
Completion times depend substantially on:
-
the learner's experience;
-
access to suitable work;
-
availability of required evidence;
-
speed at which evidence is submitted;
-
assessor feedback being acted upon;
-
site visits;
-
professional discussions;
-
internal quality assurance; and
-
awarding organisation requirements.
Any completion times stated by Assemble Skills are therefore estimates rather than guarantees unless expressly agreed otherwise in writing.
8. NVQ Induction and Resources
The NVQ induction is a substantive part of the service.
Following induction, learners may receive or obtain access to resources including, depending on the qualification:
-
portfolio workbooks;
-
evidence guides;
-
assessment instructions;
-
templates;
-
example evidence;
-
visual guidance;
-
portfolio systems;
-
assessor guidance;
-
qualification mapping;
-
support resources; and
-
other proprietary Assemble Skills materials.
Because significant services and resources are provided at or around induction, once an NVQ induction has taken place, the NVQ fee will normally be non-refundable if the learner subsequently decides not to continue.
However, this provision does not remove any statutory cancellation or refund rights that apply. Any sum retained by Assemble Skills will be limited to what Assemble Skills is lawfully entitled to retain, taking account of services already supplied, resources provided, costs incurred and any applicable consumer protection legislation.
9. Learner Responsibility for NVQ Evidence
The learner is responsible for obtaining suitable workplace access and producing sufficient evidence for their qualification.
Unless explicitly agreed otherwise in writing, Assemble Skills does not guarantee that:
-
an employer will provide suitable work;
-
a learner will obtain access to particular jobs;
-
a learner will generate sufficient evidence within a particular period;
-
an awarding organisation will accept particular evidence; or
-
a learner will successfully complete the qualification.
Assessors will explain what is required and provide reasonable support, but responsibility for producing genuine workplace evidence remains with the learner.
ATTENDANCE
10. Attendance Requirements
Learners are expected to attend all required:
-
classroom sessions;
-
practical training;
-
online sessions;
-
remote meetings;
-
assessments;
-
exams;
-
inductions;
-
professional discussions;
-
site visits; and
-
other scheduled activities.
This includes both physical attendance and online attendance where the programme or assessment requires it.
Repeated absence can make it impossible for Assemble Skills to deliver or assess the qualification properly.
11. Non-Attendance and Poor Attendance
If a learner cannot attend a scheduled session, they must contact Assemble Skills as early as reasonably possible.
Where absence has been agreed in advance with the learner's assessor and/or the Centre Manager, we will attempt to make reasonable arrangements where practicable.
Persistent unauthorised absence, prolonged non-engagement or failure to participate in required sessions may result in:
-
a warning;
-
suspension;
-
delayed assessment;
-
removal from a cohort; or
-
termination of the learner's enrolment.
A learner will not automatically be entitled to a refund because they have failed to attend or engage with a course or assessment service that Assemble Skills remained available to provide.
Any refund rights required by law remain unaffected.
CANCELLATIONS, REFUNDS AND TRANSFERS
12. Statutory Cancellation Rights
Where a consumer enters into a contract online, over the telephone or otherwise at a distance, they may have a statutory right to cancel the contract during the applicable cooling-off period.
Where the learner expressly asks Assemble Skills to begin providing services during a statutory cancellation period, including by requesting an early induction or immediate access to resources, the learner agrees that Assemble Skills may begin supplying those services.
If the learner subsequently exercises a statutory cancellation right after service has commenced, Assemble Skills may be entitled to charge a proportionate amount for services already supplied in accordance with applicable law.
Nothing in these Terms limits statutory cancellation rights.
13. Cancellation Within 14 Days of a Course Start Date
For scheduled classroom courses, practical courses, assessments and similar fixed-date provision, substantial resources may be committed in advance, including:
-
tutor and assessor time;
-
classroom capacity;
-
practical workshop capacity;
-
examination bookings;
-
equipment;
-
materials;
-
administration;
-
awarding organisation arrangements; and
-
places which may no longer reasonably be resold.
Accordingly, where a learner cancels within 14 calendar days before the scheduled course start date, a refund will not normally be available.
Where required by consumer law, Assemble Skills will nevertheless consider the actual costs and losses resulting from the cancellation and any reasonable ability to mitigate those losses. Nothing in this clause overrides statutory rights.
14. Cancellation More Than 14 Days Before a Course
Where a learner requests cancellation more than 14 calendar days before their course begins, Assemble Skills will consider the cancellation taking account of:
-
services already supplied;
-
registration or examination fees already incurred;
-
non-recoverable third-party costs;
-
administrative work already undertaken;
-
materials or resources already provided; and
-
other reasonable direct losses arising from cancellation.
Any refund or cancellation charge will be calculated in accordance with applicable consumer law.
15. Transfers and Course Changes
Requests to transfer to another course date, cohort or qualification are subject to availability and are not guaranteed.
Assemble Skills may agree to a transfer where it is reasonable and operationally possible.
Additional costs may apply where Assemble Skills has already incurred non-transferable examination, registration, tutor, assessor or third-party charges.
Repeated transfer requests may be refused.
16. Cancellation or Rescheduling by Assemble Skills
Occasionally Assemble Skills may need to reschedule a course, assessment, examination, tutor, assessor or training date because of circumstances including illness, insufficient numbers, equipment failure, awarding organisation requirements or circumstances outside our reasonable control.
Where possible, learners will be offered a suitable replacement date.
If Assemble Skills permanently cancels a service and cannot provide a reasonable alternative, any refund due will be dealt with in accordance with the learner's statutory rights and the services already supplied.
We recommend that learners do not make non-refundable travel or accommodation arrangements unless necessary. Assemble Skills is not responsible for consequential travel, accommodation or loss-of-earnings costs except where liability cannot lawfully be excluded.
ACADEMIC INTEGRITY AND MALPRACTICE
17. Plagiarism, Copying and False Evidence
All assessment evidence submitted by a learner must be their own authentic work unless another source is properly acknowledged and its use is permitted.
The following are prohibited:
-
plagiarism;
-
copying another learner's work;
-
allowing another person to complete assessed work on the learner's behalf;
-
submitting another person's photographs or videos as the learner's own evidence;
-
copying portfolio evidence from another learner;
-
falsifying workplace evidence;
-
fabricating jobs, installations, inspections or assessments;
-
altering evidence in a misleading way;
-
falsifying dates, signatures, employer details or witness statements;
-
collusion designed to mislead an assessor;
-
impersonation;
-
submitting purchased assessment work;
-
knowingly making a false declaration of authenticity; and
-
any other form of assessment malpractice.
Where appropriate, learners may use legitimate support tools, reference materials or artificial intelligence tools for learning purposes, provided their use is permitted by the assessment rules.
Artificial intelligence must not be used to fabricate workplace activity, create false evidence, impersonate the learner, falsely demonstrate competence or produce assessed work which is then dishonestly represented as entirely the learner's own work.
18. Suspected Malpractice
Where plagiarism, falsified evidence or other malpractice is suspected, Assemble Skills may:
-
pause assessment;
-
investigate the evidence;
-
interview the learner;
-
request original files or further evidence;
-
contact relevant witnesses or employers where appropriate and lawful;
-
require evidence to be resubmitted;
-
invalidate affected evidence;
-
report the matter to the relevant awarding organisation;
-
suspend the learner;
-
withdraw the learner from assessment; or
-
take any other action required by awarding organisation regulations.
Serious malpractice may result in disqualification from a qualification or assessment.
Awarding organisation decisions are outside Assemble Skills' direct control.
A learner terminated because of proven serious malpractice will not automatically be entitled to a refund for services already supplied or costs already incurred, subject always to applicable law.
BEHAVIOUR AND STAFF PROTECTION
19. Respectful Behaviour
Assemble Skills is committed to maintaining a professional and safe environment for learners, staff, assessors, tutors and visitors.
We understand that learners may sometimes be dissatisfied, frustrated or wish to challenge a decision. Learners are fully entitled to raise complaints, question assessment decisions and express disagreement respectfully.
However, abusive or threatening behaviour will not be accepted.
This applies to conduct:
-
in person;
-
by telephone;
-
by email;
-
by text message;
-
through WhatsApp or similar services;
-
through online meetings;
-
on social media; and
-
through any other communication channel.
20. Abuse, Threats and Harassment
Unacceptable behaviour includes, but is not limited to:
-
threatening staff, assessors, tutors or learners;
-
abusive or aggressive language;
-
shouting at, intimidating or bullying staff;
-
harassment;
-
discriminatory abuse;
-
sexual harassment;
-
repeated personal insults;
-
threats of violence;
-
actual violence;
-
deliberate damage to property;
-
stalking or persistent unwanted contact;
-
malicious communications;
-
threatening behaviour towards other learners;
-
deliberate disruption of lessons or assessments; or
-
behaviour which creates a genuine safety risk.
Reasonable criticism, complaints or disagreement will not by themselves be treated as abuse.
For less serious incidents, Assemble Skills may issue a warning and require future communication to take place through specified channels.
Serious abuse, violence, credible threats, harassment or conduct creating an immediate safety risk may result in immediate suspension or termination without prior warning.
Where appropriate, incidents may also be reported to the police, awarding organisation or another relevant authority.
If a learner's service is terminated because of serious misconduct, there is no automatic entitlement to a refund for services already provided or costs already committed, subject to the learner's statutory rights.
HEALTH, SAFETY AND PRACTICAL TRAINING
21. Health and Safety
Learners must comply with all reasonable health and safety instructions while attending Assemble Skills premises, practical training or assessments.
Learners must not deliberately:
-
work unsafely;
-
interfere with safety equipment;
-
energise equipment without authorisation;
-
use tools or machinery contrary to instructions;
-
endanger another person; or
-
disregard a tutor or assessor's safety instruction.
A learner may be stopped from participating in an activity where staff reasonably believe their behaviour presents a safety risk.
Serious or repeated breaches may lead to removal from training.
22. Alcohol and Drugs
Learners must not attend training or assessment while impaired by alcohol, illegal drugs or any other substance to an extent that makes participation unsafe.
Where a tutor or assessor reasonably considers a learner unfit to participate safely, the learner may be removed from the relevant session.
ASSESSMENTS, EXAMS AND CERTIFICATION
23. Assessment Decisions
Qualification achievement is based upon satisfactory completion of the relevant assessment requirements.
Payment of course or assessment fees does not guarantee that a learner will:
-
pass an examination;
-
be assessed as competent;
-
complete an NVQ;
-
receive a certificate; or
-
achieve a qualification.
Assessment decisions must be based upon the evidence and applicable assessment criteria.
24. Examination and Assessment Rules
Learners must comply with examination and assessment rules, including requirements relating to:
-
identification;
-
permitted materials;
-
mobile phones;
-
electronic devices;
-
examination conduct;
-
examination security;
-
authenticity;
-
assessment conditions; and
-
awarding organisation regulations.
Breaching assessment or examination rules may result in an assessment being invalidated and may be reported to the awarding organisation.
25. Awarding Organisation Registration and Certification
Some registrations, results and certificates are processed by third-party awarding organisations.
Assemble Skills will take reasonable care to submit the required information correctly and within applicable procedures but cannot guarantee processing times controlled by an awarding organisation.
Certification may be delayed where:
-
payment remains outstanding;
-
evidence remains incomplete;
-
internal quality assurance has not been completed;
-
an investigation is ongoing;
-
required learner information is missing;
-
an awarding organisation has requested further information; or
-
requirements of the qualification have not been satisfied.
ASSEMBLE SKILLS MATERIALS
26. Intellectual Property and Course Resources
Course materials, portfolio workbooks, evidence guides, templates, cheat sheets, presentations, photographs, graphics, videos, teaching materials and other Assemble Skills resources may be protected by intellectual property rights.
Unless expressly stated otherwise, materials supplied to a learner are for that learner's personal educational use only.
Learners must not, without written permission:
-
sell Assemble Skills materials;
-
publish them online;
-
upload them to public file-sharing sites;
-
distribute them commercially;
-
reproduce substantial parts for another training provider;
-
provide another learner with assessment answers; or
-
remove Assemble Skills branding or copyright notices for redistribution.
This does not prevent reasonable personal use for the learner's own study and portfolio.
COMMUNICATION AND LEARNER RESPONSIBILITIES
27. Contact Details
Learners must provide accurate contact information and inform Assemble Skills of material changes to their:
-
email address;
-
telephone number;
-
address; or
-
other relevant enrolment information.
Assemble Skills may communicate important information by email, telephone, text message or other agreed electronic methods.
Learners are responsible for checking communications sent to the contact information they have supplied.
28. Failure to Engage
Where a learner repeatedly fails to:
-
respond to their assessor;
-
submit required evidence;
-
attend scheduled meetings;
-
attend required training;
-
pay agreed fees; or
-
take reasonable steps to progress their qualification,
Assemble Skills may contact the learner to establish whether they intend to continue.
Continued non-engagement may ultimately result in suspension or closure of the learner's file where reasonable and permitted by awarding organisation requirements.
Where reasonably practicable, Assemble Skills will provide warning before permanently closing an inactive learner's service.
COMPLAINTS AND APPEALS
29. Complaints
Learners who are unhappy with the service should contact Assemble Skills so that the matter can be investigated.
Making a genuine complaint will not disadvantage a learner in their assessment.
Complaints should provide sufficient details for us to identify:
-
what happened;
-
when it happened;
-
the people involved; and
-
the outcome the learner is seeking.
Complaints will be handled under the applicable Assemble Skills complaints procedure.
30. Assessment Appeals
A learner who disagrees with an assessment decision may use the applicable assessment appeals procedure.
An appeal against an assessment decision is different from a complaint regarding customer service.
Where applicable, further appeal rights may exist through the relevant awarding organisation.
DATA PROTECTION
31. Personal Information
Assemble Skills processes personal information for purposes including:
-
enrolment;
-
assessment;
-
awarding organisation registration;
-
certification;
-
learner support;
-
payment administration;
-
regulatory compliance;
-
quality assurance; and
-
maintaining qualification records.
Personal information will be handled in accordance with applicable data protection legislation and the Assemble Skills Privacy Policy.
Information may be shared with awarding organisations, regulators, assessors, quality assurance personnel and other organisations where necessary to provide the qualification or where required by law.
LIABILITY
32. Our Responsibilities
Assemble Skills will provide its services with reasonable care and skill.
Nothing in these Terms excludes or restricts liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence or any statutory consumer rights which cannot legally be excluded.
33. Circumstances Outside Our Reasonable Control
Assemble Skills will not be responsible for failure or delay caused by circumstances outside our reasonable control.
These may include, depending upon the circumstances:
-
severe weather;
-
transport disruption;
-
utility or internet failure;
-
fire;
-
flood;
-
government restrictions;
-
industrial action;
-
serious illness;
-
closure of premises;
-
awarding organisation system failures; or
-
other exceptional events.
Where this occurs, we will take reasonable steps to minimise disruption and make alternative arrangements where practicable.
GENERAL TERMS
34. Changes to These Terms
The Terms applicable to a learner's booking will generally be those in effect when the contract is entered into.
We may update our website Terms from time to time.
We will not retrospectively impose a material change on an existing learner where doing so would unfairly disadvantage that learner or remove existing contractual or statutory rights.
35. Severability
If any provision of these Terms is found by a court or competent authority to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
36. No Waiver
If Assemble Skills does not immediately enforce a contractual right, this does not necessarily mean that the right has been waived.
37. Governing Law
These Terms are governed by the laws of England and Wales.
Nothing in this clause removes any mandatory consumer right to bring proceedings in another jurisdiction where applicable law gives the consumer that right.
38. Acceptance of Terms
By enrolling, making payment, attending induction or otherwise commencing the services, the learner confirms that they have been given reasonable access to these Terms and agree to be bound by them.
Where a learner books online, the key payment, cancellation, attendance and refund conditions should also be brought to the learner's attention before payment is completed.
Nothing in these Terms and Conditions affects a consumer's statutory rights.
